ANORDINANCE OF THE MAYOR AND BOARD OF ALDERMEN OF
THE CITY OF DURANT, MISSISSIPPI FOR MANUFACTURED NOMES
Purpose of Manufactured Homes
Whereas, the ordinancerecognizes and declares that manufactured homes offer anordable housingopportunities for some Durant residents. It is the intent of this section toallow tör the provision of needed and property planned locations formanufactured housing as defined in this ordinance. It is the purpose here toprovide an alternative form of affordable housing in certain residential areaswhere it is determined that manufactured housing is compatible with surroundingresidential areas. Manufactured housing may be allowed in certain residentialareas to relieve hardship situations. It also may be allowed for thereplacement/improvement of dilapidated or otherwise poor housing, to placemanufactured homes on vacant]undersized lots, and to provide for people needingclose attention and care.
Whereas, the City of Durant, Mississippi, has aninterest in the beautification of our community and to enforce the followingrestrictions;
NOW THEREFORE BE IT ORDAINED bythe Mayor and the Board of Aldermen of the City of Durant, Mississippi asfollows, to wit:
Intent of Ordinance
It is the intent of this anicle to provide requirementswhereby the officials of the city shall accurately monitor and prepare thelocation of manufactured homes within the confines of the city.
The Mayor and the Board of Aldermenwill prepare and furnish to the Code
Enforcer/Building Inspector thenecessary supplies and forms as may be necessary to effectively carry out theprovisions of this article.
The Mayor andthe Board of Aldermen will prepare necessary rules and regulations for the CodeEnforcer/Building Inspector to follow to effectively carry out the provisionsof this article.
Penalties; Impoundment
Any personfailing to comply with or violating the provisions of this ordinance shall beguilty of a misdemeanor and upon conviction thereof shall be punished as for amisdemeanor; provided, however, that a person convicted under this ordinanceshall be punished by a fine of not less than $100.00 and not more than $500.00.
Any law enforcement officer who findsa mobile home being transported Within the confines of the city in violation ofthis ordinance may have such mobile home and the vehicle transporting isissued.

Any person transporting a mobilehome which does not hase the appropriate permit as required by this articleshall be in violation of this article, and conviction under this article shallbe punished by a fine of not less than S 100.00 and not more than $500.00
Authorization of Locationby Building Official; Location Permit Required
lhe owner of such mobile home, before relocatingsuch mobile home within the confines of the city, or beyond the confines of thecity, intending to use such mobile home as a residence or for any other purposeother than resale. must obtain a permit from the City Clerk's Office. Suchperson shall also ensure with the City Clerk that all requirements have beenmet so that the mobile home is placed on the city tax records.
Payment of Permit
All applicable money must be paid before anypermit provided for in this article shall be issued.
Betöre any permitprovided for in this ordinance shall be issued, the owner of a mobile home,which home is located within any portion of the county that lies within theDurant City limits, shall furnish proof upon request that allrequirements/paynents have been paid.
Section 1: Provisions (orManufactured Homes on Separate Lots
Article 1
Manufactured homes shall be set on a permanentfoundation blocks with appropriate tie down holds as required by State FireMarshall.
Article Il
Manufactured homes shall be connected to allutilities in basically the same manner as a site built residence so that allconnections are sanitary, safe and do not create a nuisance.
Article Ill
Manufactured homes shall be connected with afoundation skirt (either block, brick, and vinyl) and permanent steps fastenedground.
Article IV
All manufactured homes shall meet the dimensionalrequirements of the area in which they are located.
Article V
The siding and roofing rntßt consist of materialscustomarily used in conventional sitebuilt homes.
Article VI
It is unlawåill for a person topark or leave standing any recreational vehicle on any public street, park,square, avenue, alley or public way in the city. In addition, any manufacturedhome or recreational vehicle on private property can be parked no longer than30 consecutive days three times a year. Homeowner must have a permit forrecreational vehicles.
Article VII
The manuthctured housed unit must bepermanently connected to utilities and used for year-round occupancy, and itmust not have wheels or axles permanently attached to its body frame.
Article Vill
Manufactured housing units are foruse as a place of human habitation, and are prohibited for commercial orinstitutional use.
Article IX
The lot mustbe landscaped to ensure compatibility with surounding properties.
Article X
Foundations and anchor systems shallbe installed according to Mississippi State Law. Every manufactured home shallbe installed in accordance with the manufacturer's "owner's manual"or at a minimum, the Uniform Standard Code for Factory Manufactured Homes Actand rules and regulations of the Mobile Home Division of the Mississippi StateFire Marshall's Office.
Article XI
Theplacement ofa manufactured home in a residential area shall reduce the propertyvalue of the surrounding property, therefore, every attempt will be made tohide the structure to he highest degree possible in the rear yard.
Article Ml
Allordinances or parts ofordinances in conflict herewith are repealed to theextent .•ssary to give this ordinance full force and effect.

Special Exceptions
Mayor and Board of Aldermen ateempowered to hear and decide whether or not proposed special exceptionsauthorized under this Ordinance should be granted after receivingrecommendations from the Code Enforcer/BuiIding Inspector. Additionally, the CodeEnforcer/Building Inspector must in consultation with the Board review and makerecommendations on each special exception application

The above and foregoing Ordinance, having been addressed andreduced to writing, was read and considered section by section and then as awhole. The question of the adoption of the Ordinance was then put to a vote bythe Mayor and the result was as follows:

The question having received amajority of the affirmative votes of all of the members of the Board ofAldermen present and voting, the Mayor declared the Motion carried and thisOrdinance adopted and approved on this the 4th day of January 2018.
